Terms of Use

Welcome to MenuPika. By using, registering for, or paying for our services, you accept these terms electronically. Please read the terms below carefully, as they govern the use of the platform, applications, and any functionality provided by MenuPika.

1. Acceptance of Terms

By accessing or using MenuPika services, you confirm that you have read, understood, and agree to comply with these terms. If you do not agree, please do not use our services.

2. Service Description

MenuPika is a digital SaaS platform for menu management in the hospitality industry. We provide tools for creating menus, multilingual publishing, menu analytics, and operational management for restaurants, cafés, and similar businesses.

3. Permitted Use

You agree not to use MenuPika services for illegal purposes, technical abuse, harmful actions, system interference, or attempts to copy the platform, its design, or functionalities.

4. Customer Content

You retain all rights to the content you upload to the platform (menus, photos, text, prices). By using MenuPika, you grant us a non-exclusive license to use that content for operating the platform.

5. Intellectual Property

All rights to the MenuPika platform, including its design, code, logo, functionalities, and documentation, are owned by MenuPika and protected by law. Copying, modifying, or republishing without authorization is not permitted.

6. Service Suspension or Termination

MenuPika reserves the right to limit or terminate your access to the service if this document is violated, the platform is abused, or usage endangers system security.

7. Service Structure and Modules

  1. The service is divided into: the Basic Package.
  2. Additional Modules (optional; no prices until officially published).
  3. The Client has no obligation to purchase any additional module until its official price is published. A module is activated only after written or electronic approval.

8. Initial Setup & Product Onboarding

  1. The Client may request that the Provider performs the initial setup and product/category onboarding.
  2. The initial setup fee is €14.99 (one-time).
  3. If the Client does not request the setup, they will upload products and categories themselves.

9. Access Delivery and Security

  1. Within 3 business days after signing the contract, the Provider sends login credentials via WhatsApp or email.
  2. The Client must change the password upon first login.
  3. The Client is responsible for any damage caused by not changing the password or by unauthorized use.

10. Pricing and Payments

  1. The annual fee for the Basic Package is 119.99 € per year, payable in advance.
  2. Payment must be made within 7 days from the invoice date.
  3. In case of delays, the Provider may apply late fees or suspend access.
  4. Activation resumes only after full payment.

11. Advertising in the Menu (Standard Version)

  1. The Provider may place partner advertisements in the digital menu.
  2. The form, frequency, and type of ads are determined solely by the Provider.
  3. The Client receives no financial compensation from ads.
  4. The Provider will not place ads for the Client’s direct competitors.

12. Ad-Free Version (Module 1)

  1. The Client may choose the ad-free version.
  2. The annual fee for this module is 249,99 € per year.
  3. It is activated at the next annual renewal.

13. Technical Support

  1. Support is provided via WhatsApp or phone.
  2. The Client uses WhatsApp knowingly and accepts its privacy risks.
  3. Support hours: Monday – Friday, 09:00–17:00.
  4. Response time: 72 business hours.

14. Minimum Technical Standard

To ensure proper functionality of MenuPika.com, the Client must provide:

  1. A stable internet connection with a minimum speed of 5 Mbps.
  2. Devices capable of opening modern websites (smartphone, tablet, PC).
  3. Up-to-date browsers such as:
    1. Google Chrome
    2. Safari
    3. Firefox
    4. Microsoft Edge
  4. A working WiFi network in the premises where the menu is used.
  5. Staff devices must be secure and free from viruses/malware.

If these conditions are not met, the Provider is not responsible for technical or functional issues.

15. Limitation of Liability

The Provider is liable only in cases of willful misconduct or gross negligence.

  1. No liability is assumed for:
    1. hosting interruptions
    2. the Client’s internet problems
    3. loss of profit
    4. indirect damages
  2. Technical availability is targeted at 98% per year.

16. Contract Termination and Data Deletion

  1. The contract has a minimum term of 12 months.
  2. It renews automatically each year.
  3. It may be terminated with 1 month’s notice before renewal.
  4. Within 14 days after termination, all Client data is permanently deleted.

17. Basic Data Protection

  1. Only the minimum data required for technical operation is processed.
  2. All data is stored on secure servers.
  3. The Client accepts the risk of communication via WhatsApp.
  4. Sensitive data is not processed.

18. Final Provisions

  1. Changes require written form (including electronically).
  2. If any provision is invalid, the rest remains in force.
  3. Jurisdiction is the Provider’s location.

19. Changes to the Terms

We may update these terms from time to time. The latest version will always be published on this page. By continuing to use the platform after changes, you accept the new terms.
